Position: OM Bank – Senior Legal Advisor Consumer & Product – Banking (3 Month Contract)

The role is responsible for end‑to‑end legal ownership of consumer‑facing matters within a newly formed bank. This includes drafting and maintaining all customer‑facing terms and disclosures, embedding legal support into product development, managing legal risk arising from marketing activity and promotions, and supporting operational legal matters in a lean legal environment.

The role requires a commercial, hands‑on legal advisor who can balance regulatory compliance, customer fairness and commercial delivery at pace.

KEY RESULT AREAS

Consumer‑Facing Terms & Customer Documentation

  • Draft, review and maintain:

    Product‑specific Terms and Conditions General banking terms and notices

    Related customer disclosures

  • Ensure documents are:

    Legally compliant

    Written in clear, plain language

    Defensible from a conduct and regulatory perspective

  • Own ongoing updates arising from legislative and regulatory change.

    • 2. Product Development & Legal Risk Advisory

  • Act as a
    legal partner to product teams from ideation through launch.
  • Identify and articulate legal, regulatory and conduct risks in product design.
  • Provide
    practical risk‑mitigation strategies that enable delivery.
  • Support governance processes for product approvals.

    • 3. Marketing, Promotions & Competitions

  • Review and advise on
    marketing material
    , customer communications and campaigns.
  • Advise on the structuring and execution of
    competitions, promotions and incentives
    .
  • Draft and approve competition rules and promotional terms.
  • Partner with Marketing, Compliance and Risk to ensure compliant innovation.

    • 4. Litigation Support, Subpoenas & Legal Notices

  • Review and assess subpoenas, court documents and legal notices.
  • Determine response obligations and engagement strategy.
  • Coordinate with external counsel where required.
  • Ensure appropriate internal escalation and record‑keeping.

    • 5. Regulatory Change & Jurisprudence Monitoring

  • Monitor material changes in:

    Consumer and banking legislation

    Regulatory standards and guidance

    Relevant case law and emerging jurisprudence

  • Translate developments into clear, actionable guidance for the business.
  • Support proactive risk management and regulatory readiness.

    • 6. Broader Legal Support (Lean Team Model)

  • Support broader commercial and operational legal matters as required, including:

    Third‑party and technology agreements

    Outsourcing and supplier arrangements

  • Contribute flexibly to team delivery during peak periods.

    • ROLE REQUIREMENTS

  • Admitted Attorney of the High Court of South Africa.
  • Strong experience (typically5–10+ years
    ) within:

    Banking, financial services or consumer finance

  • Demonstrated experience:

    Drafting customer‑facing terms and disclosures

    Advising on consumer protection and credit regulation

    Working closely with product and marketing teams

  • Sound working knowledge of:

    NCA, CPA, TCF and related conduct requirements

    Regulatory and compliance frameworks applicable to banks

  • In‑house experience in a regulated environment strongly preferred.
