Purpose

of the Job

Reporting to the Senior Manager:
Litigation and Mediation, the successful incumbent is responsible for managing and reporting on operational litigation involving issues of constitutionality.

The incumbent will support the Senior Manager on all litigation-related matters aligned with the strategic objectives of the organisation as determined by the Board.

Key Performance Areas Litigation Management

Manage the implementation of the overall litigation strategy.

Institute and defend litigation actions for and against the RAF.

Manage and monitor the litigation risk of the RAF.

Manage referred claims litigation to determine if a settlement can be reached or the matter should proceed to court.

Manage high court and magistrate court attorneys, as well as other service providers supporting the litigation unit.

Provide oversight to ensure attorneys perform their roles effectively and efficiently.

Administration of Non-Litigious Matters

Approve requests to appoint and instruct assessors and expert witnesses.

Guide in recommending settlements.

Mediation Management

Manage communication between disputing parties to facilitate mutual agreement.

Conduct introductory meetings to educate parties about arbitration processes.

Handle procedural matters in dispute resolution, including time requirements and witnesses.

Policy Review and Implementation

Contribute to developing and implementing departmental policies, procedures, and processes.

Stay updated on effective policy and practice strategies.

Reporting

Prepare and submit reports to update management and inform decisions.

Develop reports, policies, and procedures aligned with RAF’s strategy.

Create functional reporting systems for management and performance tracking.

Stakeholder Management

Facilitate and manage communication with internal and external stakeholders.

Manage relationships with judiciary, staff attorneys, and counsel.

People Management

Source, develop, and retain a high-performance team.

Implement people management processes to address workplace issues.

Allocate, motivate, and evaluate staff to achieve goals.

Qualifications and Experience

Bachelor’s Degree in Law or equivalent.

Postgraduate qualification in law is an advantage.

Mediation certification/course is an advantage.

6-8 years’ experience in a legal environment, including 3 years in personal injury litigation and 2 years in a management/supervisory role.
